Hello,
My sister who is a US citizen filed for a family based green card for our parents which was approved and received about 1.5 years ago. Since then they have been visiting the US every 6 months as they are not ready to move here permanently yet. They were told at the time of obtaining the green card that they needed to be physically in the county eery 6 months in order not to have their green cards revoked.
They just arrived in the US last week and mentioned they experienced some difficulty at the airport from one of the officials who said they should be in the country for at least 6 months.
Can someone please let me know exactly that the immigration law regarding them maintaining their green card. Also is there anything we can do or file with immigration that will not require them to have to come into the county every 6 months. Thanks.
The point is if they dont reside in the US, they dont need Greencard. its that simple.
Only reentry permit can make them able to stay abroad, but it has 2 year limit.
GotPR?,
Thanks for your response. What is the purpose of the re-entry permit and how do you go about applying for one? Does it in anyway jeopardize them losing their GC?
LPRs can come back to the US with reentry permit after long absence from the US without losing LPR status. But it expires in 2 years so that 2 years is maximum you can stay abroad.
