Topic4 Whats the average processing time?

Whats the average processing time?

I got married this February to a US Citizen and I am on H1B right now. If I apply for Green card through her right now, what forms would Ill have to file and what is the average processing time for the whole procedure?

Also, would I get my work permit with my green card or before it?

I know these are saome pretty basic questions but still wanted to get soem thoughts.

The processing time varies from 4 to 12 months.. approximately, depending on your case and on your local office. Some offices are faster than others.
Depending on when your H1B expires, you might not need and EAD card at all, since you are already allowed to work with your H1B visa, and the EAD is your work permit until the Green card is received. You could, however, apply for and EAD, just in case you will decide to work for a different employer other than the one that sponsored your current work visa..
Good luck!

Rosie,

Thanks for your reply. That is actually one of the reasons I want to get an EAD so I dont have a restriction of working only with the employers that sponsor H1B.

So would my EAD come with my green card or earlier?

And is it safe to travel during the time during these 4-12 months when your application is being processed?

So would my EAD come with my green card or earlier? Earlier - after 8 to 12 weeks. Once you get your GC the EAD is no longer needed and invalid.
