Alright folks so as many of you may know, I appealed my I-485 denial in June (07), I then received a receipt 2 weeks later and I thought hey my case is back at still pending right? well I then use my EAD and AP, at the border they process it and they tell me I can use my advance parole for a whole year. In August, I tried to apply for Finaical aid through College. I was denied and the college said that USCIS said the only thing benefit I can use is my EAD and cant gain Finaical aid until my process goes through.
In Late September, I emailed my congressman to check up for a status on whats going on with my appeal and believe it or not I dont know what to say...
This is what a person from the Detroit District Office says:
I spoke with the Adjudication Officer and he informed me that Mr. ***** can not use his benefits while his case is still pending. The Service has not made a decision on his appeal. The Service has nothing to do with Mr. **** receiving financial aid. The Officer also indicated that Mr. **** will be receiving a notification in the mail regarding his case in a couple of weeks. I trust this information was of some assistance.
This doesnt make sense one bit, the funny thing about this is that I got in contact with the officer who denied me, I talked to him back in April and he told me that once I appeal and that they grant the appeal (meaning they will investgate..etc.) I can use my benefits cause its "Pending", If I was using them illegally I would get in trouble (as he says). So Im working currently and going across the border using my AP (they check they process the AP all the time and have no problem). I honestly dont know what is going on and I have a bad feeling that this person has no idea what their talking about.
also, its been two weeks and I havent received nothing but then again ive heard alot of things from them and they never do it.
Sucks to hear... have you considered retaining a lawyer to help ou out with your case?

Decison on the appeal, I-130 was approved then my I-485 was denied and they denied it cause I used to have a green card through my previous sponser but we abanned our status but USCIS doesnt have it on record so they denied it. So I sent in 30 Pages of Evidence of me leaving the country (U.S.) more then 180 Days, coming in as a visitor, showing evidence out of Immirgation rules that I should be eligable to re-new green card through a different sponser...etc.
I do have a Lawyer but believe it or not he honestly dont know what to do and he is stuck on another case as well (deporation case).
