My uncle, his wife, and their daughter came to the US on 1/22/06, via my moms petition. So theyve been here a little over a week. But their daughter needs to go back to China for school on 2/14/06 and the greencards havent arrived at our residence yet. She has the alien number written on her Chinese passport, is that good enough, assuming that the greencard doesnt come before she leaves? Also, if its ok that she goes back to China and can come back without the greencard, what happens if there was an error on her greencard (ie fingerprint was blurry/messed up) and the US government requires her to go to an office for a re-print. But she wont be able to do so because shes in China. Thanks!
No, you dont want to do that unless you have AP
whats an AP?
that,s called advance parole,is a travel document, and in ur case, those guys are here on immigrant visa, so they should have a temporary i551 stamp in thier passport right on arrival in the u.s, which reads EVIDENCE OF LAWFUL PERMENENT RESIDENCE.check the passport if they got it, then no problem, she can go back to china and u can send her the green card when is ready,BUT remember a green card holder is not allowed to stay out of the u.s for more than 6months.if u wanna stay more than 6 months u need a re-entry. good luck
Greencard not here yet, OK to leave?
