I would like to know about Social Security Tax refunds by IRS to Nonimmigrant US workers. One of my friends worked 6 years on H1B visa, left US, and not interested to come back to USA. He would like to know how can he clime IRS and get the taxes refund (paid on his W2 for his 6 years stay in USA) and what is the procedure to approach IRS. Your help is highly appreciated
There is no way one can claim any sort of refund on social security taxes. Money you pay into SS taxes are NOT yours, they are used to pay those who are retired now. When you retire, the money to pay your social security will come from those who are working and paying SS tax at that time. SS is not like a bank account.
To be eligible for social security, one must have reached retirement age, be a US resident and should have contributed to SS taxes for at least 10 years ( SSA calls it 40 quarters).

Does this mean, the person has to reside in USA after retirement age or he can be anywhere across the globe, i.e lets say I have a green card and filled my tax returns for 40 quarters, now if I go back to some other country, am i not eligible for the SSN benifites after 65 ?
2) in case if i am eligilble, in case any event of death of that person, does the dependents gets that benifit or not ?

It depends on where you live. The SSA has a document thats been mentioned a couple of times.
